ascertaining whether information appearing in 0PM 
investigative files related to loyalty investigations, which 
were authorized by NARS for destruction, was duplicated in 
FBI files.

By letter dated 3/19/82, Dr. Donald J. Devine, 
Director of OPM, requested that the: FBI participate in an 
OPM/NARS task group with -the purpose. of verifying that 
information relating to: loyalty investigations contained in a 
sampling of OPM investigative files for which destruction- has 
been authorized by NARS is duplicated in FBI files. FBI 
participation in the task group will be limited to this 
verification. A random sampling of -1,000 OPM , investigative " . 
files has been selected. Cost data for FBI jparticipatioh _ 
will be accumulated. 

By letter dated 4/7/82, the Director informed Dr. 
Devine of the FBI *s participation in the OPM/NARS task group. 
By letter dated 4/5/82 from the Assistant Director,. Records 
Management Division to the Assistant Attorney General for 
Administration, the latter was informed of the, FBI's - . 
assistance to the OPM/NARS task group. ; 

A separate 66 file has been opened' under the above 
caption to facilitate administrative control.

Sr. fiobert M. Ffareer, Archivist of the U. S., 
prosented testiaony on the disposition of the former Civil 
Service Coigaission personnel security investlgstivo files 
Indicating his Service’s interest in the disposal of 
appreximately 20,600 cubic feet of files coveriag the years 
162S-19S0, and presently stored at the Kational Records. 

Center in Suitlaad, Maryland. Disposal of these records 
had been suspended in 197S at the request of the Senate 
Judiciary Coimittce, Dr, Warner advised the records possessed 
insufficient historical value tio warrant thoir permanent 
retention by the Archives and disposal vsouli persit the transfer 
of other agency records, cow stored at such higher cost, to 
the }?aticn.al Records Center, 

The files contain investigative information regarding 
an individual's clxaractor, conduct, end behavior in the com^nlty 
where he or she lived, and were compiled in order to permit the 
determination of suitability and fitness for employment with, the 
Fodersl Government, the Ooveraiaiost of the District of Columbia, 
or international organisations. Investigations also covered 
access and security clearances, evaluations of qualifications, 
loyalty to the United States, and evaluations of qualifications . 
and suitability for perforRaRce of contractual services for the 
Federal Governseat. 

In preparation for this hearing, eersbers of the Archives 
staffi reexamined portions of these files, looking sp^eciflcally 
for cases irivolving loyalty or other significant nsatters. The 
vast majority of the cases they exaiiined, hovevsr, documented , 
routine investigations of various persons seeking enployoent

these files consisted yri&arily, of basic "ccaytion knowledge*’ 
inforaation about these individuals , such as nane, address, and 
date of birth. ' 

Two factors bear on the original appraisal - that 
(1) the personnel security p rogram was adequately dccuacrited in 
the CoKJaission’s a*i»iiB.istrntltve~Tecords and (2) a rsore coapact 
collection of ccHparablc case files docuneating the Ecrc sub- 
staativo investigations was aialntaiued by the FBI. Additionally: 

(*) the records are arranged In a sesniter that docs not 
pereit easy identification or segregation of case files with 
potential research vslue; 

(b) screening the entire collection for the significant 
case files would iEpose an intolerable, burdan on the 0?’-i and. KARS 
(especially ia these tines of fiscal restraint), and 

(c) access to the files would be restricted for 7S years 
under KAHS General Restrictions which are based on the Freedoa 
of lafonsatioa Act (as amended) and the Privacy Act. 

In light of these circtmstances. Dr. Warner believed 
that the files, as a group, do not warrant peraaaent retettion. 

The second witness, Joseph Enatik, Chief of the 
Investigations Bvaluatlons Branch of 0PM* agreed with the 
reconsendatlon and testiw.ony of Dr. Warner and added that 
the &^aterial coriSisted of no organ! tat ioaal files but of 
individual piorscnnel files and that since. 1$3S all inforca- 
tion 0PM developed indicating a possible question of loyalty 
has been referred to the FBI. 

Following the aforeisentioned testlKcay, Assistant 
Director Robert P. Fintel, KMD, was asked how nany of the 
2 t&illioA 0PM files had, in fact, been referred to the FBI. 

Me replied that he had no vay of knewing and could not attest 
to the accuracy of Mr. Rnatik*s statesient, although he had 
no reason to doubt its veracity. In response to further ques- 
tions he indicated that aay information referred to the FBI 
by OFH would bo present in FBlHQ’s 6 1/2 million file holdings . 
as no destruction prograis had yet been approved or ioplesented.

resolved that representatives of NARS, OPM and the FBI would 
meet at the.WNRC in Suitland on 4/7/82, to review a limited 
number of old CSC files and develop an appropriate 
statistical form. The total old CSC file population stored 
at the WNRC, which will be included in the task group's 
review, is limited to "fat files" stored in 935 boxes. While 
no exact figure of investigative files could be etablished, 
it is estimated that approximately 900 files will be 
involved. It was noted that the files under consideration 
are set up in alpha betical order and run thro ugh 1959. 

On 4/7/82, Archives 

Specialist, Records Management Division, reported to the 
WNRC and participated in a limited review of old CSC files 

stored at that facility. |

by the FBI, OPM and NARS representatives. NARS 
representatives advised that a reappraisal of the old CSC 
files would be conducted by NARS. The NARS reappraisal will 
enploy a statistical survey similar to that utilized by NARS 
in appraising FBI records. It was resolved that a meeting 
would be held at FBIHQ on 4/12/82 to finalize the format of 
the statistical form and formalize plans for future action by 
the task group.

20,000 cubic feet/at the Washington National Records Center, ‘ The - 
Archivist of the United States has requested immediate disposal, 

These f lies , concerning investigations conducted between 1928 and 1959, : 
were originally scheduled for disposal after 30 years; under the provisions 
of a previous disposal schedule. , This vms later reduced to 20 -years

I believe these files must be safeguarded > pending a joint review by " 
the Senate Subcommittee, the National Archives and Records Service,, the v

In order to determine OPM’s -position on the disposition of these files , 
a number of questions need to be examined and .answered. We had considered 
a raodom sample of all files, We concluded , however, that the .information 
so generated would not give us enough evidence to be responsive to your 
concern about whether these files need to .be retained, A sample of all . 
files would yield so few security cases, that generalizations to retain 2 
or not retain would be meaningless, ;

DETAILS ; My memorandum to Assistant Director p Records Management 

Divisionp dated 4/12/82, detailed FBI participation in 
captioned project and noted that on 4/12/82, representatives from 
0PM, NARS,' and the FBI completed modifications to the data sheets 
to be used for the comparison of old Civil Service Commission 
(CSC) files stored in the Washington National Records Center, 
Suitland, Maryland, with similar records maintained by the FBI. 

On 4/23/82 and 5/10-17/82, FBI support personnel assisted 
representatives from NARS and 0PM in completing 1,371 data sheets 
at the records center. The data sheets were subsequently 
forwarded to FBIHQ for a searching and file review process to note 
the existence of FBI reports, CSC reports or correspondence, 
loyalty board transcripts and the date ^ of the last relevant 
communication in file. Personnel assigned to the Name Searching 
and File Review subunits completed thisi phase of the project.

On 6/3/82,' the completed data fheets were returned to 
NARS for their final analysis. Costs coilputed for the ^ 
totaled $4,262.16.

My memoranda, dated 4/12/82 and 6/3/82, captioned 
as above, provided details concerning a review of old Civil 
Service Commission (CSC) files stored in the Washington National 
Records Center facility in Suitland, MD, by representatives 
of OPM, NARS, and the FBI. Through the employment of a data 
sheet developed by the agency representatives, 1,360 CSC files 
were reviewed and data elements were compared through the 
review of the corresponding FBI files. The project was com- 
pleted on 6/3/82 and all data sheets were returned to NARS for 
analysis. During a subsequent meeting. of agency representa- 
tives at FBIHQ on 6/15/82, NARS concluded that the voluminous! 
or "oversized" files were permanent and should be retained.
